Section 73 (Sydney Water Compliance Certificate)

A Section 73 Compliance Certificate is the document Sydney Water issues to confirm a development has met the requirements to be adequately serviced with water, wastewater and stormwater. Named after section 73 of the Sydney Water Act 1994, it is required for new developments and subdivisions in Sydney Water’s area of operations. Without it, council or the certifier will not issue the Occupation Certificate or sign off the subdivision.

The process runs in four stages: assessment of the development plans against Sydney Water’s servicing requirements, issue of a Notice of Requirements detailing connections or asset protection works, construction of those works (where required, by a Sydney Water listed constructor coordinated through a Water Servicing Coordinator), and final issue of the Section 73 Compliance Certificate after inspection.

The current application fee via Sydney Water Developer Direct is $1,164.31 inc GST as of May 2026. Mains extensions, sewer junction cuts, and easement works require a Water Servicing Coordinator, not just a plumbing licence.
