Municipal Building Surveyor (VIC)

A Municipal Building Surveyor is the council-employed registered building surveyor in Victoria. MBS-only powers, Building Act 1993, RBS role explained for builders.

A Municipal Building Surveyor (MBS) is the council-employed registered building surveyor in Victoria, holding statutory office under the Building Act 1993 (Vic). Every Victorian council must appoint one. The MBS administers Parts 3, 4, 5, 7, and 8 of the Act and the Building Regulations within the council’s municipal district (s 212). The person appointed must be registered as a building surveyor under Part 11 of the Act at a class authorising the full MBS function.

What an MBS does on residential builds:

  • Considers applications for and issues building permits (the VIC equivalent of a CC).
  • Issues occupancy permits at completion.
  • Inspects work at the mandatory stages set by the permit and the regulations.
  • Investigates unsafe or dangerous buildings and pool-safety-barrier compliance.
  • Enforces compliance with building permits, including building notices and building orders for non-compliant work.
  • Maintains the council’s permit register.

MBS-only powers (not available to a private RBS). Some powers under the Act sit only with the Municipal Building Surveyor:

  • Emergency orders: only an MBS can issue an emergency order under the Act.
  • Building orders for unsafe or unauthorised buildings outside an active permit also typically default to the MBS unless a private RBS is the appointed RBS for that work.

Relationship to “Relevant Building Surveyor” (RBS). The RBS is the building surveyor appointed to a specific piece of building work. That can be either a private RBS engaged by the owner, or the MBS where the council is doing the certifying. Once appointed, the RBS for a job is the inspection contact, the permit issuer, and the OC issuer for that work, regardless of whether they are private or council. The MBS retains the statutory enforcement role across the whole municipal district in parallel.

For builders. Choosing the MBS over a private RBS is sometimes a deliberate decision (council projects, owners who prefer council oversight, or jobs where private cover is unavailable). Most volume residential work goes through private RBSs, but knowing the MBS exists as the alternative and as the enforcement backstop matters when a council inspector turns up to a job.
