SoEE (Statement of Environmental Effects)

What a Statement of Environmental Effects is, when it's required for a NSW DA, what it must cover, and who prepares it under the EP&A Act 1979.

A Statement of Environmental Effects (SoEE) is a written report submitted with a Development Application (DA) in NSW. It explains the proposed development to the consent authority (usually council) and demonstrates how it responds to relevant planning controls and environmental considerations. Under the Environmental Planning and Assessment Regulation 2021 (NSW), a SoEE is mandatory for all DAs other than designated development or state significant development, which require a full Environmental Impact Statement instead (verified 2026-05-07).

What a SoEE covers

At minimum, a SoEE addresses:

  • Site analysis: existing site conditions, land use, topography, vegetation
  • Planning instrument compliance: assessment against the LEP, DCP, and applicable SEPPs (including BASIX, bushfire, and heritage policies)
  • Environmental impacts: traffic, parking, privacy, overshadowing, and neighbourhood character
  • Heritage and bushfire: if the site is affected, the SoEE must address those overlays specifically
  • Merit-based assessment: where the proposal varies from a control (e.g. a setback or height limit), the SoEE must justify the departure by demonstrating the underlying objectives are still met

Depth and length scale with the complexity and sensitivity of the proposal. A simple secondary dwelling on a standard lot needs a shorter document than a dual occupancy on a heritage-listed or bushfire-affected site.

Who prepares it

A town planner, architect, or building designer typically prepares the SoEE. For straightforward proposals, some owner-builders prepare their own. Councils often publish templates or fact sheets as a starting point. The SoEE is the primary document council staff use when assessing the DA against the matters set out in s 4.15 of the Environmental Planning and Assessment Act 1979 (NSW) (verified 2026-05-07).
