A small works contract in NSW residential building is the short-form contract template used for residential building work in the value band between $5,000 (the licensing threshold) and $20,000 (the HBCF insurance threshold). It is distinguished from a “large works” or “major works” contract by the value band, the deposit limit, the disclosure obligations, and the absence of a Home Building Compensation Fund (HBCF) certificate requirement (verified 2026-05-16).

Where each contract form applies (NSW residential):

Contract value (incl. GST)Contract formHBCF required?
Below $5,000No licence required; no contract requirementsNo
$5,000 to $20,000Small works contract (HIA Small Works, ABIC SW, custom short-form)No
Over $20,000Large works contract (HIA New Home / Renovations, ABIC Major Works)Yes

(The licensing threshold is $5,000 incl. GST under the Home Building Regulation 2014.)

Key contractual provisions on a small works contract (NSW):

  • Written form required: even though HBCF is not required, the contract must be in writing per Home Building Act 1989 (NSW) Schedule 2.
  • Deposit cap: typically 10% of the contract sum, often less by industry convention on smaller jobs.
  • Cooling-off period: 5 clear business days if the contract value is over $20,000; below that, cooling-off does not statutorily apply but is good practice.
  • Statutory warranty obligations apply under sections 18B onwards of the Home Building Act 1989 (NSW); these cannot be contracted out of regardless of contract size.
  • Mandatory disclosure: licence number, expiry, current registration class.
  • Plain English explanation of price and time required.

Common applications:

  • Small bathroom renovations under $20,000.
  • Kitchen refurbishments at the lower end.
  • Decking, pergolas, garage build under $20,000.
  • Small carpentry trades on a residential site.
  • Re-stumping or small footing repairs.

What changes between small works and large works:

  • HBCF insurance becomes a statutory requirement at $20,001 and above. Below that, no HBCF.
  • Cooling-off period statutorily required only over $20,000.
  • Plain-English disclosure lighter on small works.
  • Progress payment limits more constrained on small works (fewer claim points expected).

Industry forms commonly used:

  • HIA Small Works: the HIA’s short-form contract for value-banded residential work.
  • ABIC Simple Works (SW-2018): the ABIC-suite short-form, architect-administered or non-administered variant.
  • Master Builders Small Jobs Contract: similar in scope.

Also known as: small jobs contract; minor works contract; short-form residential contract; ABIC SW.
