Progress claim

A progress claim is a written demand for payment of completed construction work, governed by Security of Payment Acts across Australia.

A progress claim (also called a payment claim under the NSW Security of Payment Act) is a written demand served by a contractor or subcontractor on the respondent (head contractor or owner) for payment of construction work or related goods and services completed to date. Under the Building and Construction Industry Security of Payment Act 1999 (NSW) s 13, a valid claim must be in writing, identify the work or services claimed, state the claimed amount including GST, and include the statutory endorsement: “This is a payment claim made under the Building and Construction Industry Security of Payment Act 1999” (verified 2026-05-10, NSW Government, Making a payment claim).

Claims can only be made on or after a reference date. Once validly served, the respondent must issue a payment schedule within 10 business days or the full claimed amount becomes due.
