Notice to rectify

A notice to rectify requires the builder to fix defective work within a stated time, the contract counterpart to a regulator's direction to rectify.

A notice to rectify is a written notice (from the owner, the superintendent, or a regulator) requiring the builder to fix defective or non-conforming work within a stated time. It is the contract-level counterpart to a regulator’s statutory direction to rectify.

It comes in two forms that work the same way but carry different teeth:

  • Contractual: under most building contracts, the owner or superintendent can issue a written notice identifying the defect and requiring it be rectified within a reasonable (often specified) period, typically during the defects liability period. It puts the builder on formal notice and is the step that usually has to happen before the owner can engage someone else and claim the cost.
  • Statutory (direction to rectify): a building regulator (for example NSW Fair Trading, the QBCC) can issue a direction to rectify defective work, which is an enforceable order with consequences for the licence if ignored.

The notice should identify the specific defect, reference the contract or standard it breaches, and give a clear timeframe and access arrangements.

For a builder the practical points are to treat a notice to rectify seriously and respond within the time: a genuine defect is cheaper to fix yourself than to have rectified at your cost (or to face a regulator’s direction and a licence mark). Where you dispute that it is a defect (fair wear and tear, owner damage, a maintenance item, not a breach), respond in writing on the record rather than ignoring it. For an owner, a clear written notice to rectify, with the defect and a reasonable timeframe, is usually the necessary first step before any claim or further action. Distinguish genuine defects from omissions and minor finishing items, which are handled on the defects list rather than by formal notice.
