NCAT (NSW Civil and Administrative Tribunal) is the primary forum for resolving residential building disputes in NSW, established under the Civil and Administrative Tribunal Act 2013 (NSW). The Home and Property Division handles claims under the Home Building Act 1989 (NSW) including statutory warranty claims for defective or incomplete work, disputes between owners and builders, and complaints against owner-builders (verified 2026-05-08).

NCAT is designed to be accessible and lower cost than court proceedings. Claims for building defects are typically lodged within the statutory warranty period (6 years for major defects, 2 years for other defects from practical completion). The tribunal can order rectification, payment of damages, or other remedies. Decisions are binding and enforceable.
