Mutual recognition (builder licensing)

Mutual recognition is the legal mechanism that lets a builder (or other licensed practitioner) registered in one Australian jurisdiction be recognised to carry out equivalent work in another jurisdiction, without having to fully re-qualify or re-license. The framework sits under the Mutual Recognition Act 1992 (Cth). There are two related pathways (verified 2026-05-15):

  1. Traditional mutual recognition. The original mechanism since 1992: the practitioner applies to the target jurisdiction’s licensing authority for an equivalent licence, citing their existing home-jurisdiction licence. The target authority must grant the equivalent licence unless the activity is outside scope. Application fees and processing time apply.
  2. Automatic Mutual Recognition (AMR). Introduced in Part 3A of the Mutual Recognition Act from 1 July 2021. The licensed practitioner is deemed to be registered in the target jurisdiction without lodging an application or paying a fee, provided they meet the home-jurisdiction conditions and notify the target authority. The activity-scope rules of the target jurisdiction still apply.

The ACT exemption is one-way: an ACT-licensed builder can use AMR to operate in other AMR jurisdictions, but an interstate builder cannot use AMR to start work in the ACT and must instead apply through the traditional mutual recognition pathway with the Construction Occupations Registrar.

Practical takeaway. A NSW-licensed builder working in Victoria or WA can typically operate under AMR after notification. The same builder taking a job in Brisbane or Canberra must go through the traditional application process, with timing and fee implications worth scoping at the contract stage.
