CC (Construction Certificate)

What a Construction Certificate is in NSW, who issues it, when it is required after DA approval, and when a CDC bypasses it entirely.

A Construction Certificate (CC) is the approval that must be obtained after a Development Application (DA) is granted but before any building work starts on site. It confirms two things: that the construction plans and specifications are consistent with the development consent, and that they comply with the National Construction Code (NCC) (the BCA). Issued under Part 6 of the Environmental Planning and Assessment Act 1979 (NSW) (verified 2026-05-07).

Who issues it

A CC is issued by your appointed PCA (Principal Certifying Authority), which can be your local council or a registered private certifier. The PCA must be appointed before the CC can be issued. The certifier checks that the detailed construction drawings, engineering plans, and specifications are consistent with the DA consent conditions and satisfy the NCC (verified 2026-05-07 via NSW Planning, Stage 5 Guide).

When it is required

The CC is a post-DA, pre-build gate. The sequence is: DA approval, then CC, then Notice of Commencement, then work starts. No building work can commence before the CC is in hand. The detailed engineering and specifications are typically only finalised at this stage, after the DA locks in the concept design (verified 2026-05-07).

What accompanies a CC application

Common documents required (per the EP&A (Development Certification and Fire Safety) Regulation 2021 (verified 2026-05-07)):

  • Detailed architectural and structural engineering plans
  • BASIX certificate (mandatory for new dwellings and additions over $50,000 in NSW)
  • Fire safety schedule (for building classes other than dwelling houses)
  • Energy efficiency documentation
  • Specifications and materials schedule consistent with the DA consent

When a CDC bypasses the CC

If the project proceeds via a Complying Development Certificate (CDC) rather than a DA, no separate CC is required. The CDC itself authorises building work directly, combining the planning and building approval steps.
